Fast food restaurant chain agrees to settle class action resulting from cyberattack

The Wendy’s Company, a fast food chain, has announced a $50 million settlement of the putative class action brought by financial institutions in 2016, for damages stemming from cyberattacks on the point of sales systems between October 2015 and March 2016.  The plaintiffs claim that Wendy’s failed to protect customer payment card information, and failed to provide timely notice of the breach, causing losses due to reimbursements of fraudulent charges on the compromised payment cards, cancellation and re-issuing of the cards.  The proposed settlement is pending approval by the United States District Court for the Western District of Pennsylvania.
