Enforcement authorities are increasingly examining private credit firms. The SEC’s 2026 examination priorities for investment advisers include an explicit focus on private credit. Similarly, late last year, U.S. Attorney for the Southern District of New York Jay Clayton raised concerns about the valuation practices used in private credit, adding, “People should know that the financial regulators and the Department are looking at [private markets],” including private credit. Given this intense scrutiny from enforcement authorities, now is the time for firms to prepare for such investigations.
