In a speech at the ABA White Collar Crime conference in New Orleans, Assistant Attorney General Brian Benczkowski, who leads DOJ’s Criminal Division, extolled DOJ’s efforts to foster transparency in corporate enforcement matters, highlighting the Department’s recent publication of an “anti-piling on” policy, the FCPA Corporate Enforcement policy, and further guidance on the selection and use of monitors. Benczkowski also announced a new annual training program for white-collar prosecutors focused on how to evaluate the effectiveness of corporate compliance programs in order to promote greater consistency in the exercise of prosecutorial discretion in corporate enforcement matters.
