On December 20, 2024, the U.S. Department of Justice proposed a new rule that would update, clarify and modernize Foreign Agents Registration Act (“FARA”) regulations. FARA requires U.S. persons who act as agents of foreign principals that engage in certain specified activities to make periodic disclosures concerning their relationship with the foreign principal and evidence of disbursements received in support of those activities. According to the DOJ, the proposed rule will change certain exemptions, including the commercial exemption and the exemption for person qualified to practice law, and will modernize regulations to enable informational materials to be labeled in line with technological advances that have occurred since the regulations were last amended.
The DOJ welcomes public comments on the Notice of Proposed Rulemaking (“NPRM”), which is currently published in the Federal Register. Written comments on the NPRM must be submitted within 60 days of the date of publication in the Federal Register.
