On March 14, 2023, the US Federal Trade Commission (“FTC”) finalized its order against Epic Games, Inc., the creator of the Fortnite video game, settling allegations that the company violated Section 5(a) of the FTC Act by engaging in unfair or deceptive practices, including illegal “dark patterns” to trick users into making unintended in-game purchases and incur charges without authorization. The Settlement requires Epic Games to pay $245 million, among other requirements.
