US District Court dismisses privacy claim against Illinois court clerk

The United States District Court for the Northern District of Illinois, Eastern Division, has dismissed a lawsuit claiming that the Clerk of the Circuit Court of Cook County violated the Driver’s Privacy Protection Act (DPPA), 18 U.S.C. § 2721, et seq,  by disclosing personal information from the plaintiff’s motor vehicle records.  The complaint, filed in July 2018, alleged that identifying information about the plaintiff such as gender, date of birth, address, and driver’s license number were made available to the public at computer terminals located at Cook County courthouses after the plaintiff received a speeding ticket in 2005.  The US District Court dismissed the complaint without prejudice on the grounds that the DPPA does not provide a private right of action against the Clerk of the Cook County court.
