Robocall case settled for $1,150,000

On September 12, 2019, the US District Court for the Northern District of Alabama issued an order and final judgment approving the class action settlement in a case originally brought in December 2016 by Robert Hossfeld against BBVA Compass Bancshares.  The plaintiff sought redress under the Telephone Consumer Protection Act, 47 USC § 227,  claiming that he and others had received unsolicited automated telemarketing calls to their cellphones made by or on behalf of Compass without the recipients’ consent.

On February 13, 2019, the court granted preliminary approval to the class action settlement, and conditionally certified the class, consisting  of non-customers of Compass whose cell phones were called by the MSR Group, LLC for survey purposes on behalf of Compass between December 2012 and February 2019.

To settle the TCPA action, Compass agreed to pay $1,150,000.
