OFAC issues FAQ to clarify Executive Order 13959

On January 4, 2021, the Office of Foreign Assets Control of the US Department of the Treasury issued Frequently Asked Question 862, which answers in the negative the question whether Executive Order 13959, issued on November 12, 2020, requires US persons to divest their holdings in publicly traded securities of the Communist Chinese military companies named in the annex to the Executive Order.  According to the FAQ, EO 13959 does not require divestiture by US persons, including US funds and related market intermediaries, before the January 11, 2021 deadline.  Additional clarifications are contained here and in FAQs 857, 858, 859, 860, and 861, dated December 28, 2020.
