On April 1, 2021, President Joseph Biden signed an Executive Order terminating the national emergency declared in Executive Order 13928 of June 11, 2020, Blocking Property of Certain Persons Associated With the International Criminal Court (ICC), and revoked that order pursuant to the International Emergency Economic Powers Act, the National Emergencies Act (NEA), and the Immigration and Nationality Act of 1952. As part of the revocation, the President suspended any travel restrictions against any individuals designated pursuant to the EO and had the Office of Foreign Assets Control remove those individuals from the Specially Designated Nationals and Blocked Persons List.
According to the new EO, while the US continues to object to the ICC’s jurisdiction over its personnel and the personnel of its allies, and will vigorously protect them from any attempt by the ICC to exercise that jurisdiction, the President felt that the imposition of financial sanctions against the ICC was not an effective or appropriate way to address these concerns.
