EU publishes guidance note related to Myanmar sanctions

On May 11, 2021, the European Commission published a guidance note to address questions that are likely to arise regarding the implementation of certain provisions of Council Regulation (EU) No. 401/2013 and restrictive measures related to situation in Myanmar/Burma, including Council Decision 2013/184/CFSP.  The purpose of the note is to ensure the uniform implementation of regulation provisions by EU operators and national competent authorities (NCA).

The guidance note provides a general overview of all Myanmar sanctions that are in place, including a section that addresses what financial sanctions entail and a discussion on who must comply with certain regulation provisions.  Thera are also suggestions for EU operators on not only how to determine who has been targeted by Myanmar sanctions but also how to discover whether property is owned or controlled by sanctioned parties.  Finally, the Commission examines the exceptions to financial sanctions, including provisions that address potential obstacles to the delivery of humanitarian aid to the people of Myanmar.
