Enforcement and Litigation Risks Arising from ESG Disclosures

In this seventy-five minute presentation, Willkie partners Todd Cosenza and William Stellmach address the extent to which environmental, social and governance disclosures pose litigation and enforcement risks for companies and investment managers, and how best to navigate these risks.  Discussion topics include a comparison between ESG and traditional economic metrics, risks to companies such as shareholder or regulator actions for misleading statements or breach of fiduciary duty, and how to reconcile the risk of litigation or enforcement investigations with the pressure to make commitments to safe, just, humane and sustainable operations.
